JUSTIFICATIVA</p></div><p style="padding-left: 35pt;text-indent: 0pt;text-align: left;"/><p style="padding-top: 11pt;padding-left: 35pt;text-indent: 0pt;line-height: 150%;text-align: justify;">A insuficiência do Poder Judiciário para atender a todas as demandas que lhe são submetidas é tema que há muito vem sendo discutido, sempre com o objetivo de buscar uma solução que responda aos objetivos do Estado Democrático de Direito, no que diz respeito ao acesso à justiça, à razoável duração do processo e à garantia do contraditório. O CPC de 2015 exerceu com mestria o mister de promover a adequação do sistema processual brasileiro aos princípios e garantias da Constituição Federal de 1988, alinhando-se ao conceito de “justiça multiportas”. A tradicional via do processo judicial, que de regra alberga a figura do demandante e do demandado em polos opostos e sustentando pretensões resistidas, ganha, a partir das inovações do CPC de 2015, como um estímulo irrecusável à utilização de métodos de solução consensual de disputas, como a conciliação e a mediação,</p><p style="text-indent: 0pt;text-align: left;"><br/></p><p style="padding-left: 35pt;text-indent: 0pt;line-height: 150%;text-align: justify;">além de reconhecer a arbitragem como método válido de jurisdição. O chamado sistema de justiça multiportas, termo cunhado a partir de uma metáfora - onde se imagina um Poder Judiciário dotado de várias portas, meios e mecanismos para a resolução adequada de um conflito - recebeu, no Brasil, o primeiro grande impulso com a Resolução 125/2010 do CNJ porque consistiu no primeiro regramento quanto à implementação e aplicação adequada das técnicas autocompositivas nos tribunais de todo o país. Reconhecendo que a atividade jurisdicional estatal não é a única capaz de resolver conflitos, o sistema oferece aos jurisdicionados diferentes mecanismos de tutela de direitos, cuidando que cada método seja adequado para determinado tipo de disputa. A adequação do método visa inclusive atender aos aspectos sociológico e psicológico da demanda, o que de regra não é alcançado por uma sentença proferida por agente de poder estatal. A jurisdição estatal passa a ser apenas mais uma dentre as diversas portas disponíveis. Nada obstante, o número de processos judiciais distribuídos segue em escala crescente operando uma sobrecarrega gigantesca, acima da capacidade de julgamento dos tribunais brasileiros em todas as instâncias. O Sistema Judiciário Estatal é incapaz de dar conta de tamanha litigiosidade e mostra sinais de sufocamento e ineficiência, haja vista a morosidade que desse quadro resulta. Nesse sentido, a desjudicialização e a prevenção de litígios têm se tornado temas cada vez mais relevantes no cenário jurídico atual e se tornou uma missão política do Supremo Tribunal Federal e do Conselho Superior da Justiça do Trabalho. A desjudicialização e a prevenção de litígios também contribuem para a economia de recursos, tanto para as partes envolvidas quanto para o sistema de justiça como um todo. Resolver um conflito de forma extrajudicial, além de ser mais rápido, pode ser mais acessível</p><p style="text-indent: 0pt;text-align: left;"><br/></p><p style="padding-left: 35pt;text-indent: 0pt;line-height: 150%;text-align: justify;">financeiramente, o que torna o processo menos custoso para todos. Portanto, incentivar a desjudicialização e a prevenção de litígios é essencial para garantir uma justiça mais ágil, eficaz e acessível, além de contribuir para a construção de uma sociedade mais harmônica, em que as disputas possam ser resolvidas de forma mais colaborativa e menos adversarial. A adoção dessas práticas representa um avanço significativo para a modernização do sistema jurídico e para a melhoria do acesso à justiça para todos.</p><p style="text-indent: 0pt;text-align:
